If u have a litter of puppies and stud dog owner has pick of litter then decides they cant collect puppy but?

they cant collect the puppy but dont want a stud fee instead whats the best thing to do ?a contract was signed stating that pick of litter failing that the stud fee should be paid before any of the stud dog details will be handed over(for kc reg)
